Products have been bought and sold, passed on to others, and have caused harm (as well as good) to people for centuries. Liability for products has become an issue in modern times because of two features. First, unlike vegetables in the market or shoes in an artisan’s shop, the consumer of many complex modern machines, medicines or gadgets is not in a position to see whether they are safe before she purchases them for herself and her family. Secondly, she is not typically buying from the producer, the farmer or artisan, but from a retailer who may not be better placed to inspect the product, especially if it comes pre-wrapped from the manufacturer.
